I have a question here, and I want to know what you guys think.
This involves my position where I work, and the fact that they want me to travel to Kansas City and I do not want to go. No we are not a union plant.
First, TRAVEL is not specified anywhere in my job desription. I read it thoroughly, nothing tells me that I have to go anywhere. My boss tells me though that he can MAKE me go, even despite the fact that I may not want to, and despite the fact it's not in my job description. This guy is not an A hole....he's a good manager who is just under alot of pressure regarding this one particular issue.
Second, I've got a medical reason at the moment that prohibits me from going. I can get the signed document from my doctor saying I should not go.
Does my company have any re-course if I don't go? I've got legitimate reasons I can't, they say I may have to anyway. I refuse to let them push me around.
I just want some input here, not looking for free legal advice or anything like that, but if someone knows the law reagarding this, by all means post or semd me PM.

What kind of 'plant' do you work?
And what level of management so to speak are you?
They cannot make you do anything against your will like that in my book. But what about the last line in the job description that says "And other duties asigned..."

I work for a company that build torque converters, dual mass flywheels, clutches and discs etc. for OE appplications: Honda, Toyota, Chrysler, Ford, GM, Nissan, and some others. I am in the prototype department, my title is Project Planner, and I also schedule all the proto builds for manual trans products, as well as delegate who does what to get it done. Basically, I am 1/2 a step below my immediate supervisor in rank, even though I am really the one who keeps the department going.
But now you really get into a gray area when you start looking for terms or words in this job desription that might be "interpreted" in many ways. I can't speak to that right now, I don't have the job description in front of me. What I am saying is that nowhere does it specifically say "you will travel if we ever ask you".
And then there's the medical reason I can't go.....they certainly can't get around that I wouldn't think.....
Don't misunderstand me here; I've traveled for this place MANY times, but it was another position, and the job title dictated I do so. It was different altogether. |

If you ever feel threatened by any individual in an upper management position, KEEP RECORDS!

Who
How
Where
Harrasment doesn't have to be sexual to be harrasment.
It is CYA in the long run.
Remember you are not a slave, you are an employee. Some managers need to be reminded of that from time to time. |

If the doctor says you really can't go, then they shouldn't send you. But IANAL.
As an example, one of my co-workers (I'm in NY, labor laws do vary from state to state and rules form company to company) had a minor surgical procedure this past week. He was out 2 days, plus another because he didn't feel good enough to come back. Friday, he came back, but without a note from his doctor. HR told him he had to get a note from the doctor clearing him to return to work, or else go home.
This is for a total desk job. If you're walking around a manufacturing plant, I imagine the doctor would be even more strict.
Cougar is mostly right. Document, document, document. However, if management tells you you need to go someplace, and your reponse is "I don't wanna", you can suck up and deal with it, or you can accept the consequences of refusing (this is excluding the medical condition). They can't hold a gun to your head and force you to get on the plane, but they also aren't obligated to keep you on the payroll if you're going to be insubordinate, especially if you work in an at-will state.
First thing Monday morning, talk to your doctor about this trip. If he says you can't go, get a signed statement from him on the spot that specifically states such. |

Only you know how badly you don't want to go. Only you can gauge what impact not going will have on your career. Only you know how much you enjoy your job.
In the end, you have to look at how important this trip would be to your employer, and how badly you do not want to go. To me, the fact that your boss has said that he could force you to go, means that refusal to go will be a CLM (career limiting move). |

Well then so be it. I will not be pushed around and made to fear for my job here. I'll kiss noone's a$$ to get anywhere in this company because that's NOT me. Where I've gotten so far has been on merit and performance, but truthfully they don't appreciate anything anymore, all they want is more more more.
He actually hasn't said anything else about it, so maybe he got enough people to take care of this debacle. And a debacle it is. We have seriously pissed off Ford Motor company by shipping them 1400 BAD torque converters that go in the many versions of the Escape. So Ford DEMANDED that this company send people to their facility in Kansas City to assist with changing these converters out. They wanted 6 people with certifications and credentials to work on new, never titled vehicles.
That crap isn't in my job description, and I won't do it. |

| So there!!! Oh BTW you're not a white male at or around 50 years old, are you? Not to scare you but that can change things. I spent a lot of years in a position that I ended up describing as indentured servitude. Obviously I was not a slave, this is America, I could've left, but it would have been financial suicide for my family. Sometimes employers have you by the you know whats. But when they make semi threats you may want to consider leaving this company at some time in the future when you can arrange it. If they've done it once they'll do it again. |
