That's what the warranty is for, no? I live only 2 hrs away from the factory, so I would simply drive there and insist on a swap.

...when you buy a car you have to realize the it is not an investment. Investments make money...cars depreciate the second you drive it off the lot and you are going to lose $$$ when you sell...unless of course it is something sold at auction @ Barret/Jackson.
Cars are basically a tool to get from point A to point B...it's just that some tools are nicer tools than others..

Your car has a problem. No matter how large or small, it is Subaru's responsibility to correct the issue. If they won't, I would look into the lemons laws for your areas.

People are quick to pull the "lemon law" card but depending on area it can be quite difficult and time consuming to get satisfaction, and requires the vehicle be tied up in the service area for a significant amount of time. Before the lemon law, I'd try a second dealer, though I think the OP should find a way to "convince" the selling dealer to resolve the issue.
Think about it this way........How is this any different than if the trannie threw a code after 10k/6 months? As long as they fix it, it would not concern me. Sometimes you are the windshield, other times you are the bug.
Well, you can call it an "investment" if the returns you expect aren't in some form of official currency. Cars can return more than just cash, especially if you have to commute in one. A car that lets me commute and be in a good mood when I get to work has much better "returns" than a car that makes me grumpy from having to drive it during the commute. At least from my perspective.

I'm sure the folks at the factory are happy to simply swap cars with any recent new owner who drives up to the factory with a warranty issue...

If new car electrical issues bother you then I highly advise that you only purchase cars with 30,000 or more on them given all cars have the potential for having electrical bits fail in the first few days or the first say 30K given this is the period where electrical components which might be flawed or not quite right will fail. If the components are all OK then the honeymoon period is up you very seldom have issues.
I had a relay switch fail on my head lights at 5000 miles talk about annoying not having lights to drive at night! Took the dealer 5 minutes to find it and replace it no big deal 40,000 miles now no issues I made it past the electrical bits honey moon period with one failure.

I've shared another story regarding electrical stuff in the past. Good friend bought a super super nice cherry red top of the line Miata with 23,000 miles on it at auction for $10,000. Really nice car!
The issue the dash was dead! No lights no working instruments or gauges etc. He replaced the blown fuses got in started it up drove it around seemed just fine. He put it in reverse and bang dash was dead again. Dealer history showed that the dealer had given up trying to find the fix and purchased the car back from the owner and sent the car to the auction. He replaced the back up switch on the MT and drove the car for a year with zero issues then sold it for $18,000. Flawed $2 back up switch was shorting the whole dash.

SOA called me this afternoon and has agreed to put me into a new vehicle due to my concerns with the current vehicle I am driving. I am thankful and happy that they do stand by their products and seem to care about owners...It took many phone calls and emails but those at Cust Service were always apologetic and appeared to truly emphathize. Ill let you all know the specifics once they are worked out.

This tale demonstrates how diagnosis has been reduced to only that which the computer readout can do. Simple problems require that the point of convergence be identified. Most of the time, it takes some thinking time, not even much actual disassembly and scrutiny. Good on your buddy for getting such a good deal.

Well, whaddya' know.....not sure too many other manufacturers would have done that. Congrats on a perfect (ulitmate) outcome !!!!
Picked up the new one yesterday. Have to thank SOA and Ed Reilly Subaru in Concord NH for assisting. It took many emails and phone calls, but SOA showed that they do care about the quality of their vehicles. BTW- new one past that 250 mile mark and no CEL Yeah...
Yeah...Congrats, not only on your new ride but on helping to restore a little confidence in the human race. Ask any third grader what the just outcome would have been and they could give you the answer immediately. Glad yours worked out--may you have many years of trouble-free driving as recompense for your effort.
Hello - The CEL and a host of other lights all came on with my new 2013 OB 3.6 2 days ago as I was drivign my daughter to school.
Had the car towed back to dealer and service dept contacted SOA technet to determine why the code "malfunction detected with transmission solenoid" popped up. SOA instructed service dept to reset computer, test drive vehicle, ask owner to keep an eye out if it should pop again. Per service dept, SOA said this was something new to them so they have assigned an open case number to my vehicle. If it should happoen again, to immediate tow it back to dealership and a SOA tech would be dispatched to investigate.
This new car has a total of 79 miles on it. NOT HAPPY considering it's my first subaru ever...

Got to be a glitch with the redesigned tranny. Sucks, but it happens...
Edit: NVM, just realized 3.6, not the 2.5 with the new CVT. Still sucks, but even more odd, then. The 5 speed's been around for a while, you would think they shook the bugs out already.
