I'm usually totally form over function as well, but a spoiler helps these cars look much better in my opinion. So aesthetics do occasionally win out for me.
Yep - "cosmetics" it is...however, many people still like those... when I removed mine, I has hard time to figure out, how to plug the holes, but luckily, I found rubber plugs that fit exactly into those holes...

jogo, the spoiler on a hatchback deflects some of the wind off the roof blows it over the hatch glass to keep it free of 3 season dust / and winter road sand. (got one on my current wagon)

like the fancier version of the clear plastic dust deflector. (I had one of those on my previous 2000 outback wagon)

on a sedan,....the spoiler is just for looks,...unless you got something that can run up over 120mph,...but then I would want to read up on it and see if it actually is not just a poser but actually provides the high speed benefit. (got one on my 2.5 sedan now,...I am considering removing and selling it though)
Hmmm - when I was removing mine from 10 Forester XT (and I contacted SOA for instructions) I was told (by them) that those are pure cosmetics and serve no other purpose. Also, if you do some thorough research, the benefits that you have mentioned are questionable nor proven. In wind tunnels the vortex created behind the car by those actually increases dirt/dust build up on rear windshield - but, you can believe what you want.

After one trip to climate, where it snowed and rain/ice build upon those, I found those to be a pain...and I removed it! They don't inhance the look of the car (in my opinion) - a better set of wheel is much better way to spend money on car looks.

Nepbug - good luck with that template. When I was removing mine I encountered stiff resistance from SOA - they refused to give me any help. I had to get some diagrams from a body shop to see where the bolts and clips were. Maybe things are different in Canada. I think you will get better info from a body shop. Also if spoiler wasn't OEM you will have problems with with bolts

It's like adding a roof rack on a car that did not have OEM roof rack to start with. The bolts that go through the roof have to have stainless steel reinforced inserts otherwise the roof rack will not hold properly. Have done that - have been through that. This is not to discourage you - just heads up!

Yes, I removed something that came with my Forester XT as OEM installed (it wasn't added). Some 2010 Foresters came with spoilers and some didn't, depending on model. I don't understand what you are trying to say about lawyers and such...

When I sold that car, I put that spoiler back in the trunk (with all hardware) for future owner. He may or may not have installed it back - I don't know and I don't care. I don't think that it devalued the car - but that is my opinion - you may think otherwise.

When I called Subaru (to get instructions how to remove it) they wouldn't do it. I had to get the body shop to give me a schematic for location of bolts and clips. While talking to SOA they just said, what I posted earlier. Well, what can I say - I don't have any control of what they do nor say - I am a consumer. I am just posting here, what I have done and why.
